The right of withdrawal for consumers
1. Right of withdrawal
As a consumer within the meaning of the Consumer Protection Act, you are entitled to withdraw from this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the day when you or a third person indicated by you, except the carrier, have or has acquired possession of the goods.
To exercise your right of withdrawal, you have to inform us (Gletscherbahnen Kaprun AG, Wilhelm Fazokas Straße 2d, 5710 Kaprun, phone: +43 (0)6547 8700, fax: +43 (0)6547 7614, e-mail: email@example.com) with a clear statement (e.g. a letter sent by mail, fax or e-mail) about your decision to withdraw from this contract. Your may use the attached model withdrawal form, which is, however, not compulsory.
To comply with the withdrawal period, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period has expired.
2. Consequences of withdrawal
If you withdraw from this contract, we have to refund you all payments we received from you, including the delivery costs (except any additional costs resulting from you choosing another type of delivery than the most economic standard delivery we offered), without delay and within fourteen days from the day at the latest when we received the notification of your withdrawal from this contract. We will use the same means of payment for the refund you used for the original transaction, unless expressly agreed otherwise with you; in no event will we charge you any fees for such refund.
We may refuse the refund until we retrieved the goods, or until you submitted proof that you returned the goods, whichever is the earlier date.
If you received any goods from us, you shall return or hand over the goods without delay and within fourteen days from the day at the latest when you informed us about your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You shall bear the direct costs for returning the goods.
You have to pay for any diminished value of the goods only if such diminished value is caused because you handled the goods in a manner which was not necessary to check the quality, properties and functioning of the goods.
If you requested the services to start during the withdrawal period, you shall pay us a reasonable amount corresponding to the share of the services already performed up until the time when you notified us that you are exercising your right of with-drawal for this contract, in comparison to the total volume of services provided in the contract.
